Access to this website attributes to the person obtaining such access the status of “user”. By the mere fact of using this website, the user fully accepts the terms and conditions established herein and agrees to do so in accordance with the law and respecting the further instructions for use contained on this website, as well as the General Conditions for Use of the BANCOTEL Checkbook.

The user declares under his responsibility that he is of legal age and has the legal capacity to operate on the website. He undertakes being financially liable for everything he carries out on this site. He also declares that all information he furnishes is true and accurate, without limitations, reservations or misrepresentations. He agrees that the possibilities for reservation by means of this website will only be used in order to make legitimate reservations or orders for the user or for a third person who has duly authorized him to do so. The excessive or abusive use of this website may have as a consequence that he be denied access to the services contained herein.

Access to and use of certain services and applications offered on this website require prior registration of the user through the general registration form.

Users, upon registering, consent to and accept the inclusion of their data in a personal data database and the automated processing thereof by the party responsible for the database, PROMOCIÓN Y PLANIFIACIÓN HOTELERA, S.A. (PROTEL), Mahón, 6-8, 28230 Las Rozas, Madrid (Spain) for the purpose of:

* Sending commercial information to the interested party on any activity or tourist or leisure offer by any company of the PROTEL group.

* Assigning the interested party’s personal data to companies of the PROTEL group and to third parties to inform him of the activities and/or tourist and commercial promotions thereof.

* Assigning his personal data to the destination hotel and to the companies that have to intervene in the servicing of the reservation and/or trip, regardless of the country in which located, only in order to service the reservation and guarantee the execution thereof.

* The interested party is liable for the veracity and updated status of the personal data furnished and may exercise his rights to access, rectification, cancellation and objection pursuant to Organic Law 15/1999, by contacting PROTEL for such purpose.

Use of website, its services and contents



The user agrees to use this site, its services and contents without violating the fundamental rights of the person, current law in force, good faith, generally accepted uses and public order. The use of the site for illegal purposes or purposes harmful to PROTEL or any third party or which may howsoever impair or prevent the normal functioning thereof or of any information systems or documents of any type contained therein, is prohibited. With respect to content (information, texts, graphics, sound and/or image files, photographs, designs, etc.), the following is prohibited:

* Reproduction, distribution or modification, unless authorized by their legitimate owners or it is legally permitted.

* Any violation of the rights of PROTEL or of their legitimate owners.

* Their use for any type of commercial or advertising purposes, other than as strictly permitted. Thus, for example, it shall be prohibited to send messages not solicited or consented to by their recipients.

* Any attempt to obtain the contents of the website through any means other than as made available to users or customarily employed on the Internet, provided that the latter do not cause any damage to PROTEL’s website.

* To delete, manipulate or howsoever alter the “copyright” and other identification data of the reservation of the rights of PROTEL or the holders thereof, of digital fingerprints or any other technical means established for recognition thereof.

User’s liability for damages

The use of the website shall be carried out under the total, exclusive liability of the user. Said liability shall extend to the use on the part of the user or any third party, of any passwords or similar codes assigned for access to the website or any of its services.

Notwithstanding the above, PROTEL reserves the right to deny, at any time, and with no need for prior notice, access to the website or the provision of services to those users who breach the instructions of use contained therein, or General Conditions or individual conditions which, in each case, are applicable thereto.

Unilateral modification

PROTEL, whenever it deems appropriate, may unilaterally modify, without prior notice, the structure and design of the website, as well as modify or eliminate its services, contents and conditions of access and/or use.

Persons or entities that intend to make or make a hyperlink from a website of another Internet portal to any of the pages of PROTEL’s portal must submit to the following conditions:

* PROTEL shall not be liable for the contents or services made available to the public on the website or portal from which the hyperlink is made, or for the information and representations included therein.

* Any hyperlink to PROTEL’s portal shall be made to its homepage or homepages of the sections it contains.

PROTEL’s portal makes available to users connections and links to other websites managed and controlled by third parties. Said links have as their exclusive function to facilitate to users the search for information, contents and services on the Internet, without in any case being considered to be a suggestion, recommendation or invitation to visit them. PROTEL does not market, manage, or previously control, or keep as its own the contents, services, information and representations available on the said websites.

PROTEL assumes no type of liability, not even indirectly or subsidiarily, for damages of any type which may derive from the access, maintenance, use, quality, legality, reliability and usefulness of the contents, information, communications, opinions, representations, products and services which are existing or offered on websites not managed by PROTEL and which are accessible through PROTEL’s Portal.

Personal data protection



Privacy Policy..

In various forms of the website, PROTEL and/or the companies belonging or related to its Group compile personal data and information on users which they include in their databases (hereinafter, the “Party Responsible for Database”), for storage and automated processing which, in any case, must be accepted by the user, who may exercise his right to access, rectification, cancellation and objection in accordance with Organic Law 15/1999, by contacting PROTEL for such purpose.

In each one of the firms in which personal data are compiled, the user shall receive from the Party Responsible for Database detailed information on the processing, purpose thereof, the use of his data, the obligatory or optional nature of his responses, effects deriving from not providing them and, in general, all mentions required by applicable law on the subject of personal data protection.

The Party Responsible for Database agrees to process the personal data of users in accordance with the provisions of applicable regulations and, in particular:

* to treat confidentially the user’s personal data to which it has access as a consequence of his surfing the Portal. Notwithstanding the above, the Party Responsible for Database may disclose the personal data and any other information concerning the user for the purposes indicated under the section “Prior registration” and when required by the public authorities in exercise of the functions legally attributed thereto and in accordance with applicable provisions.

* to adopt the security measures of a technical and organizational nature necessary for avoiding the alteration, loss and unauthorized processing of or access to said data.

The user agrees to:

* Maintain the data provided to the Party Responsible for Database duly updated.

* Diligently maintain custody of his e-mail and password, adopting such measures as are necessary to avoid the loss, misplacement, disclosure to third parties or unauthorized use thereof.

* Make an adequate and diligent use of his e-mail and password, being solely responsible for the illicit use thereof or use contrary to these conditions and to the individual conditions which, in each case, are applicable.

The user shall be liable for any damages which PROTEL, the companies belonging or related to the PROTEL Group and/or third parties may suffer as a consequence of the absence of veracity, inaccuracy, lack of effectiveness and authenticity of the data furnished or the breach of the duties enumerated above.

Use of “cookie” technology



Description:

Cookies constitute a tool used by web servers to store and recover information concerning their visitors. They are nothing more than a small text file which some servers request of our browser to write on our hard disk, with information concerning what we have been doing on their sites.

Cookies are divided into two types: session cookies and permanent cookies. Session cookies are not stored on the user’s machine; they disappear when the current session ends. Permanent cookies have an extremely far-away expiration date, and remain stored on the user’s computer after ending the session.

Cookies employed on this website: PROTEL occasionally uses cookies to facilitate surfing through its portal and in order to obtain a greater efficiency and personalization of the services offered to users.

The cookies employed at PROTEL are associated solely with an anonymous user and his computer, do not provide references which allow inferring the name and surnames or other data of the user and cannot read data from his hard disk or include viruses in their texts. Furthermore, PROTEL cannot read the cookies implanted on the user’s hard disk from other web servers.

PROTEL employs cookies for several purposes:

Exclusion of warranties and liability

PROTEL grants no warranty nor is it liable, in any case, for damages of any nature which may have their origin in:

* The non-availability, accuracy, current status, maintenance and effective functioning of this website and/or of its services or contents.

* The lack of usefulness, adequacy or validity of this website and/or of its services or contents to satisfy needs, activities or specific results or expectations of users.

* The existence of viruses, malware, or programs containing harmful contents.

* The illicit, negligent, fraudulent use, use contrary to these conditions, to good faith, to generally accepted uses or to public order, of the website, its services or contents, on the part of users.

The exchange rates which appear on this website are based on public sources and are used only as guidelines. However, PROTEL in no case warrants the precision of such guidelines.



Term of Duration

The term of duration of the functioning of the website and of the services and applications thereof is indefinite. Notwithstanding the above, PROTEL reserves the right to interrupt, suspend or terminate the aforesaid services unilaterally and without prior notice, without prejudice to the fact that, when reasonably possible, PROTEL will previously advise of any interruptions in the functioning of the website and of the services forming it.

Intellectual Property

The contents of the website are the intellectual property of PROTEL or of the companies belonging to the PROTEL group, without any of the rights to exploitation which exist or may come to exist on the said Contents being deemed to be assigned to the user beyond what is strictly necessary for the correct use of the website and of the services.

For the purpose of preserving potential intellectual property rights, in the event that any user or a third party considers there to have been a violation of his legitimate rights by the introduction of a specified contents on the website, he must notify such circumstance to PROTEL indicating:

* Personal data of the interested party that is the holder of the rights allegedly violated. If the claim is presented by a third party other than the interested party, he must indicate the representation pursuant to which he is acting.

Governing Law and Jurisdiction

PROTEL and the user shall be governed by Spanish law for such matters as may arise or actions brought as deriving from the functioning of the website, its services and contents and as to the interpretation, application, performance or breach of the provisions hereunder.



Record of visits

PROTEL informs the user that upon accessing PROTEL’s server, the IP address from which he is browsing shall be obtained and his access to the server, as well as the pages he visits belonging to PROTEL, recorded. These data shall be stored in a LOG file, which shall be processed by PROTEL for the purpose of determining the number of pages viewed at PROTEL, as well as to compile statistics.
